The direct answer

The CY2027 final rule reduces the minimum sales and marketing call-record retention to six years, with audio retained for the first three years and qualifying complete transcripts permitted in the later years. Enrollment records need a separate assessment.

Separate record classes before changing retention

The CY2027 rule reduces the minimum marketing and sales call retention period to six years. Audio remains required for the first three years; years four through six may use audio or complete, accurate transcripts. Enrollment documentation remains a separate retention assessment. Do not apply one shortened policy to every recording in the agency's storage account.

Review current CMS provisions, carrier contracts and any other applicable obligations with the responsible record owner. Create separate categories for marketing or sales, enrollment and unresolved mixed records. An uncategorized file should enter review rather than automatically inherit the shortest setting.

Inventory where the recordings actually live

List the telephone platform, webinar or meeting platform, archive provider, backup store and any transcript tool. Identify who controls retention settings and who can retrieve files after an account closes. A contract promising storage is useful only if the agency can find and access the required record later.

Export a sample inventory containing record identifier, call date, type, storage location, format and access status. Keep private call content out of ordinary traffic dashboards. The inventory should support retrieval and policy administration without unnecessarily spreading sensitive material.

Test completeness at capture

Check that the actual recording is present, playable and connected to the right call record. Test beginning, middle and ending segments, not merely whether a file exists. Include the audio portion of relevant web-based calls in the agency's reviewed capture workflow.

Storage duration cannot compensate for a file that was incomplete or missing when created.

  • Record the call's stable identifier and date.
  • Confirm the classification used for retention settings.
  • Check that the entire required record can be retrieved.
  • Document capture failures and the operating response.
  • Restrict access to people who need the record for their role.

Treat transcripts as records, not summaries

Where the later-year transcript option applies, assess whether the transcript reflects the complete recording accurately. A short AI summary, meeting note or list of action items is a different artifact. Review the transcript process for omitted speakers, numbers, dropped segments and transcription errors before relying on it.

Keep a controlled migration record when changing format. Identify which audio file the transcript corresponds to, how completeness was checked and who approved the transition. Preserving a hash or stable archive identifier can assist the technical record linkage, but it does not independently establish content accuracy.

Work through an illustrative storage review

An agency discovers that its calling provider retains audio for twelve months while its archive contains only automated summaries. The operational problem is incomplete retention, even though staff believe the CRM keeps every call. The owner checks contractual responsibilities, repairs the archive path and tests retrieval of a complete sample.

In another example, an older record includes both marketing discussion and enrollment. The owner does not delete it under a generic six-year rule. It is routed to the separate classification and retention review. These examples show why the record class must control the storage action rather than a filename or age alone.

Make deletion a controlled decision

Before changing a platform's automatic expiration setting, review all affected categories, contractual requirements, holds and backups. Document the approved policy and the records it covers. A shorter minimum does not require indiscriminate deletion of records the agency still needs to preserve.

Schedule retrieval tests after provider migrations and periodically during normal operation. Check an older record as well as a recent one. The useful measure is whether a required complete record remains available in the permitted format for its applicable period, with a traceable policy and accountable owner behind the storage settings.

Questions agents ask

Is a transcription summary enough?

The later-year allowance concerns complete and accurate transcripts, not a short AI-generated call summary.
